Official Rules
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT IMPROVE YOUR CHANCES OF WINNING ONE PRIZE.
Eligibility
This “Inked in San Diego” Dayseeker Charity Raffle (Giveaway) is open to all natural persons who are legal residents of North America and are at least 18 years old at the time of entry. The Giveaway is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law.
Sponsorship
The Giveaway sponsor is Dayseeker (“Sponsor”), located at 20630 Plummer St, Chatsworth, CA 91311. Sponsor and its respective affiliates, subsidiaries, successors, assigns, agents, representatives, officers, directors, shareholders, and employees, and any entity involved in the development, production, implementation, administration, judging, or fulfillment of the Giveaway, including without limitation, the immediate family members of such individuals, are not eligible to participate. Sponsor will conduct the Giveaway substantially as described in these Official Rules.
Entry Period
This Giveaway begins on January 25th, 2024, at 11:00 AM PST and ends on February 26th, 2024, at 9:00 AM PST (“Entry Period”).
How to Enter
The raffle begins at 11:00:01 a.m. Pacific Time (“PT”) on January 25, 2024, and ends at 9:00:01 AM. PT on February 26th, 2024 (“Sweepstakes Period”). The Sponsor’s computer is the official time-keeping device for the Sweepstakes.
1) Online Store Entry: Eligible Entrants will be able to enter the raffle by visiting the Sponsor’s website located at https://dayseeker.band/ (the “Website”) and making a purchase.
NOTE: “ANY FRAUDULENT ACTIVITY IN CONNECTION WITH THIS PROMOTION IS STRICTLY PROHIBITED. IT IS FRAUDULENT TO PURCHASE ITEMS TO OBTAIN ENTRIES WITH THE INTENT TO RETURN THESE ITEMS AFTER THE PROMOTION. SUPPOSE THE SPONSOR IDENTIFIES OR SUSPECTS THAT YOU ARE ENGAGED IN THIS OR ANY OTHER FRAUDULENT ACTIVITY. IN THAT CASE, YOU WILL BE DISQUALIFIED AND BANNED FROM ANY FURTHER SWEEPSTAKES OR PROMOTIONS OFFERED BY THE SPONSOR.”
2) Mail-in: Eligible Entrants also have the option to obtain ten (10) Sweepstakes entries via mail by legibly hand-printing, on a 3”x 5” card or paper, their full name, complete mailing address, phone number, and e-mail address, and mailing the card in a #10 envelope, with proper postage affixed, to Inked in San Diego Dayseeker Charity Raffle, 20630 Plummer St, Chatsworth, CA 91311. You may submit as many postal entry requests as you wish (up to 10 entries applied), but each request must be mailed separately. All entries must received by February 26th, 2024.
Prize: “Inked in San Diego”
If you are the lucky winner of a pair of the Inked in San Diego Raffle, you and a guest will be flown to San Diego to meet Dayseeker and attend their show at Soma on May 25th. Solely, the prize winner will collaborate with tattoo artist Bobby Johnson on a tattoo design (Session length MAX 6 hours, must be sober the day of the tattoo). All travel, accommodations, and logistics will be coordinated between the prize winner and Dayseeker Management.
Winner agrees to accept the Prize “as is,” and entrants hereby acknowledge that neither Sponsor is in any manner responsible or liable for any warranty, representation, or guarantee relative to the Prize, including warranties provided exclusively by a prize supplier.
The approximate retail value of the Prize is $5000. Any difference between the stated approximate retail value and the actual value of any Prize will not be awarded. The winner is solely responsible for federal, state, and local taxes. The winner must provide the Sponsor with a valid Social Security number or taxpayer identification number before the Prize is awarded. [A Form 1099 will be issued to the Prize winner.]
LIMIT ONE PRIZE PER PERSON.
Drawing
Winners will be selected randomly from eligible entries collected during the Entry Period on or about February 27th, 2024, at the Sponsor’s principal place of business. The Sponsor will conduct the drawing, whose decisions and interpretations on all matters relating to the Giveaway and these Official Rules are final and binding in all respects. Sponsor reserves the right to disqualify any entrant or winner and may refuse to award a prize to a person who is not eligible, has violated a rule, gained unfair advantage in the Giveaway, or obtained winner status using fraudulent means. Suppose there is a dispute about the identity of an entrant. In that case, the prize will be awarded to the natural person to whom the email address is assigned by the internet service provider responsible for the domain associated with the submitted email address. If the winner is found to be ineligible or not in compliance with Giveaway rules, the winner will be disqualified, and an alternate winner will be awarded the Prize in a separate random drawing. The winner will be notified by email. The inability of the Sponsor to contact the winner by email within seventy-two (72) hours after selection may result in the winner's disqualification, and an alternate winner may be selected in a random drawing at the Sponsor’s discretion.
Odds
The odds of winning will depend on the number of eligible entries received, according to the eligibility requirements in the Giveaway.
WARNING: ANY ATTEMPT BY ANY PERSON, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER WITH, OR VANDALIZE ANY SPONSOR-OWNED WEBSITE OR MOBILE APPLICATION OR RELATED SOCIAL NETWORKING SITE, THE ENTRY PROCESS, OR OTHERWISE INTERFERE WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
General Terms
By entering this Giveaway, you promise to abide by the Official Rules and decisions of the Sponsor, which will be final and binding in all respects. Sponsor reserves the right, at its sole discretion, to refuse, disqualify, or withdraw any entry at any time. The sponsor will not be responsible for any injury, damage, or loss arising from your participation in the Giveaway.
YOU AGREE TO RELEASE, DISCHARGE, AND HOLD HARMLESS THE SPONSOR, ITS AFFILIATES, SUBSIDIARIES, EMPLOYEES, OFFICERS, DIRECTORS, AGENTS, AND ASSIGNS FROM AND AGAINST ANY OR ALL CLAIMS, LOSSES, INJURIES, OR DAMAGES RESULTING FROM PARTICIPATION IN THE GIVEAWAY. Except where prohibited by law, by accepting a prize, the winner grants the Sponsor a perpetual, worldwide, royalty-free license to use the winner’s name, photograph, voice, and likeness without further authorization, compensation, or remuneration of any kind for advertising, promotion, and other publicity purposes in any and all media now or hereafter known throughout the world.
Winner List Request
You may request confirmation of the name, city, and state of residence of the Prize Winner by sending a self-addressed, stamped #10 envelope by February 27th, 2024, to Inked in San Diego Dayseeker Charity Raffle 20630 Plummer St, Chatsworth, CA 91311. The confirmation will be provided as permitted by law.
